1. At some point during the transaction, the “on behalf of party” will:
a. have physical custody of and transport the gas received and delivered by Northern; or
b. hold title to the gas received and delivered by Northern for a purpose related to its status and functions as a qualified party under the “on behalf of” rules of the Commission’s regulations; or
2. The gas is destined for an end-user physically connected to an intrastate pipeline or to an end-user in the local distribution company’s service area. Shipper and the “on behalf of party” hereby certify and warrant that the transportation service requested by the Shipper shall be on behalf of the party who is eligible for such service in accordance with the above-designated criteria.
